TERMS OF SERVICE

These Terms of Service ("Terms") constitute a legally binding agreement between you, whether personally or on behalf of an entity ("you"), and Worqai ("Worqai," "we," "us," or "our"), concerning your access to and use of worqai.io, www.worqai.io, and any related website or application on which these Terms are made available (collectively, the "Service").

By creating an account or otherwise accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must not use the Service.

We may make changes to these Terms at any time and for any reason. We will alert you to changes by updating the "Last updated" date above. Your continued use of the Service after a revised version is posted means you accept the changes. It is your responsibility to review these Terms periodically.

The Service is intended for users who are at least 18 years of age.

1. DESCRIPTION OF THE SERVICE

Worqai is a tool that uses artificial intelligence to help you with your résumé/CV. The Service can:

Score your résumé and produce an ATS-compatibility audit (including a free, no-account audit);
Improve your résumé by rewriting and polishing it; and
Tailor your résumé to a specific job description.

Worqai generates suggestions and content; you decide whether and how to use them. We may add, change, or remove features at any time.

2. ELIGIBILITY AND USER REPRESENTATIONS

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that: (1) all information you submit is true, accurate, current, and complete, and you will keep it updated; (2) you have the legal capacity to agree to these Terms; (3) you are not a minor in the jurisdiction in which you reside; (4) you will not access the Service through automated or non-human means except as expressly permitted; (5) you will not use the Service for any illegal or unauthorized purpose; and (6) your use of the Service will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we may suspend or terminate your account and refuse any current or future use of the Service.

3. ACCOUNT REGISTRATION AND SECURITY

To use most features you must create an account. You may register with an email and password or by signing in with Google. You are responsible for keeping your credentials confidential and for all activity that occurs under your account. Notify us immediately at support@worqai.io of any unauthorized use of your account.

4. PLANS, FEES, AND PAYMENT

Worqai offers a monthly subscription and a one-time Job Search Starter Pack (bundle). Current prices are shown on the pricing page and may change at any time.
Payments are processed through Polar, which acts as the Merchant of Record and issues the receipt for your purchase. Applicable taxes are shown at checkout before you complete your purchase. All payments are in the currency indicated on the payment page.
By making a purchase you authorize us (through Polar) to charge your chosen payment method for the amounts due.
Subscriptions renew automatically at the then-current price until you cancel. You consent to recurring charges without prior approval for each charge, until you cancel.
You agree to provide current, complete, and accurate purchase and account information, and to keep your payment information up to date.

We reserve the right to correct any pricing errors, even if we have already requested or received payment, and to refuse or cancel any order.

5. CANCELLATION AND REFUNDS

You can cancel your subscription at any time from your account at https://www.worqai.io/es/cuenta, or by emailing support@worqai.io. Cancellation takes effect at the end of the current paid period; you retain access until then.

Unless applicable law requires otherwise, payments are non-refundable once the corresponding service has been consumed (for example, once a tailor, improvement, or audit has been generated). Refund requests are reviewed case by case at our discretion. For full details, including how to request a refund and your statutory right of withdrawal, see our Refund & Withdrawal Policy. Nothing in this section limits any non-waivable refund or withdrawal rights you may have under the consumer-protection law of your country of residence.

6. YOUR CONTENT

When you use Worqai you upload or paste content, most importantly the text and structure of your résumé/CV and, for the Tailor feature, a job description ("Your Content").

You retain ownership of Your Content. We do not claim any ownership of it.
You grant Worqai a limited, non-exclusive license to host, process, and transmit Your Content solely to provide the Service to you, including processing it through our artificial-intelligence and infrastructure providers as described in our Privacy Policy.
We do not use Your Content to train our own AI models, and we work with providers whose terms likewise do not use Your Content to train their models. See §7.
You are responsible for the accuracy and truthfulness of Your Content. Worqai does not verify it.
You represent that Your Content is yours to submit, that you have any necessary rights and permissions, and that submitting another person's information without their authorization is prohibited (see §8).

This license ends when you delete the relevant content or your account, except for residual copies that may remain in encrypted backups for a limited period as described in the Privacy Policy.

7. ARTIFICIAL INTELLIGENCE AND NATURE OF THE SERVICE

The core features of Worqai are powered by a third-party AI provider, Google's Gemini API, used on a paid tier under which Google does not use the content you submit, or the content Gemini returns, to train or improve its products. See §4 of the Privacy Policy.

You acknowledge that:

AI-generated output may contain errors or inaccuracies. You must review and verify all content before relying on or using it.
We do not guarantee that using Worqai will result in interviews, job offers, or any specific employment outcome.
You must not use the AI features in any way that violates Google's applicable terms or policies. The AI features are designed for natural-language processing of résumé and job-description text only.

8. ACCEPTABLE USE AND PROHIBITED ACTIVITIES

You may use the Service only for lawful purposes and only as permitted by these Terms. You agree not to:

Upload content that does not belong to you or that infringes the rights of any third party.
Upload another person's information without their authorization.
Use the Service to generate fraudulent, false, or misleading content.
Share account credentials so that multiple people use one account, or sell or transfer your account.
Attempt to breach, overload, disrupt, or interfere with the Service or its supporting networks.
Circumvent, disable, or interfere with security-related features or usage limits, including the limits on the free anonymous audit.
Copy, adapt, decompile, disassemble, or reverse-engineer any part of the Service.
Use any automated system (bot, scraper, data-mining tool, etc.) to access the Service or extract data from it, except for standard search-engine indexing.
Resell, sublicense, or commercially exploit the Service without our written authorization.
Use the Service in any way that violates applicable law or regulation.

Violating this section may result in suspension or termination of your access (see §14).

9. FEEDBACK AND SUBMISSIONS

Questions, suggestions, experience reports, and other feedback you send through our feedback form ("Submissions") are stored privately for review, support, and product improvement. We will not publish a Submission or publicly attribute it to you as a testimonial unless you give separate, affirmative publication permission in the form or later. Giving permission does not require us to publish it, and you may withdraw permission for future use by contacting support@worqai.io.

You represent that a Submission is yours to provide or that you have the necessary rights. Do not include confidential information belonging to an employer, recruiter, client, or other third party. Our collection, retention, and deletion of Submissions are described in our Privacy Policy.

10. OUR INTELLECTUAL PROPERTY

The software, source code, designs, branding, logos, text, graphics, and other materials that make up the Service (excluding Your Content and Submissions) are owned by us or our licensors and are protected by intellectual-property laws. Subject to your compliance with these Terms, you are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use. We reserve all rights not expressly granted to you.

11. THIRD-PARTY WEBSITES AND SERVICES

The Service may contain links to third-party websites or rely on third-party providers (for example Google, Supabase, Polar, Vercel, Inngest, and Resend, as described in our Privacy Policy). We do not control and are not responsible for the content, accuracy, or practices of third-party websites or services. If you access a third-party website or make a purchase through a third party, you do so at your own risk and subject to that third party's terms and policies.

12. PRIVACY

We care about data privacy and security. Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand what information we process and how. Although we perform routine backups, you are responsible for retaining your own copies of any content you value, and you agree we are not liable for any loss or corruption of data, to the extent permitted by applicable law.

13. SERVICE MANAGEMENT

We reserve the right, but not the obligation, to: (1) monitor the Service for violations of these Terms; (2) take appropriate legal action against anyone who violates the law or these Terms; (3) refuse, restrict, or disable access to any content or to the Service; and (4) otherwise manage the Service to protect our rights and property and ensure its proper functioning.

14. TERM AND TERMINATION

These Terms remain in effect while you use the Service. We may, in our sole discretion and without notice or liability, suspend or terminate your access to the Service, including deleting your account and associated content, if you breach these Terms or misuse the Service, or as otherwise permitted by law.

You may stop using Worqai and delete your account and all associated data at any time at https://www.worqai.io/es/cuenta (see §15 of the Privacy Policy). If we terminate your account for breach, you may not re-register under another name without our permission.

15. MODIFICATIONS AND INTERRUPTIONS

We may change, modify, suspend, or discontinue all or part of the Service at any time, with or without notice. We cannot guarantee the Service will be available at all times; it may be affected by maintenance, hardware or software problems, or causes beyond our control. To the extent permitted by law, we are not liable for any loss or inconvenience caused by your inability to access the Service during any downtime or discontinuance.

16. DISCLAIMER

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY AI-GENERATED CONTENT WILL BE ACCURATE OR FIT FOR YOUR PURPOSE. YOU USE THE SERVICE AT YOUR OWN RISK.

17. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WORQAI AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU, AND NOTHING HERE LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

18. INDEMNIFICATION

You agree to defend, indemnify, and hold Worqai harmless from any loss, damage, liability, claim, or demand, including reasonable legal fees, made by any third party arising out of: (1) Your Content; (2) your use of the Service; (3) your breach of these Terms; (4) any breach of your representations and warranties; or (5) your violation of the rights of a third party.

19. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the Republic of Costa Rica, without regard to conflict-of-law principles. Any dispute shall be submitted to the competent courts of Costa Rica, without prejudice to the mandatory consumer-protection rights granted to you by the law of your country of residence, which continue to apply where they cannot lawfully be waived.

20. ELECTRONIC COMMUNICATIONS

By using the Service, sending us emails, and completing online forms, you consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that they be in writing. You consent to the use of electronic records and signatures, to the extent permitted by applicable law.

21. MISCELLANEOUS

These Terms and any policies posted by us constitute the entire agreement between you and us regarding the Service. Our failure to enforce any right or provision does not waive it. If any provision is found unlawful or unenforceable, that provision is severable and does not affect the remaining provisions. We may assign our rights and obligations at any time. No joint venture, partnership, employment, or agency relationship is created by these Terms.
